Short Title

This Order may be cited as the European Communities Privileges and Immunities Order.

Interpretation

In this Order,

Convention means the Convention on the Privileges and Immunities of the United Nations; (Convention)

Organization means the European Communities; (Organisation)

senior official means a person designated as a senior official of the Organization by the President of the Commission of the Organization and accepted as such by the Secretary of State for External Affairs. (fonctionnaire supérieur)

Privileges and Immunities

The Organization shall have in Canada the legal capacities of a body corporate and shall, to such extent as may be necessary for the performance of its functions, have the privileges and immunities set forth in Articles II and III of the Convention.

Unless in any particular case a privilege or immunity is waived.

senior officials shall have in Canada, to such extent as may be necessary for the performance of their functions, the privileges and immunities referred to and specified in section 19 of the Convention.

officials of the Organization, other than senior officials, shall have in Canada, to such extent as may be necessary for the performance of their functions, the privileges and immunities specified in section 18 of the Convention; and

experts performing missions for the Organization shall have in Canada, to such extent as may be necessary for the performance of their functions, the privileges and immunities set forth in Article VI of the Convention for experts on missions for the United Nations.
